Terms and conditions
1. Scope
These Terms and Conditions apply to all design and consulting services provided by Toni Pötzl Mediendesign, Christian-Jorhan-Str. 7, 85445 Aufkirchen, Germany, unless otherwise agreed in writing.
2. Services
Services may include branding, web design, digital design, UX/UI design, editorial design, campaign design, consulting and related creative work. The exact scope of services will be defined in the respective offer, briefing or written agreement.
3. Conclusion of contract
A contract is concluded once the client accepts an offer in writing, confirms a project by email or otherwise approves the scope and pricing.
4. Client responsibilities
The client shall provide all content, materials, information and approvals required for the project in a timely manner. Initial inquiries and project-related communication may take place by email or through the contact form on this website. Delays on the client side may affect timelines and delivery dates.
5. Pricing and payment terms
Unless otherwise agreed, projects are billed on a per-project basis.
Payment is generally made in three stages:
50% upfront before the project starts
25% during the project
25% upon completion and handover
Invoices are payable within 14 days without deduction.
6. Additional work and changes
Any work beyond the agreed scope, including additional revisions, new deliverables or substantial changes requested after project approval, may be charged separately.
7. Delivery and timelines
Estimated timelines are communicated in advance based on the agreed project scope. Delivery dates are non-binding unless expressly agreed otherwise in writing.
8. Revisions
The number of revision rounds included in a project shall be defined in the respective offer or agreement. Additional revision rounds may be billed separately.
9. Third-party services and development
Unless expressly agreed otherwise, the provider does not offer custom development, backend programming or technical implementation beyond the agreed design scope. If technical support or third-party services are required, these must either be provided by the client or arranged separately.
10. Usage rights
All concepts, designs and deliverables remain the intellectual property of the provider until full payment has been received.
Upon full payment, the client receives the agreed usage rights for the final approved deliverables. Unless otherwise agreed, usage rights are granted only for the agreed purpose and scope.
Drafts, preliminary work and rejected concepts may not be used without explicit written permission.
11. Portfolio use
The provider reserves the right to display completed work in portfolios, on the website and in self-promotional materials, unless explicitly agreed otherwise.
12. Liability
The provider shall be liable only for intent and gross negligence, except where mandatory statutory liability applies. No liability is assumed for indirect damages, loss of profit or technical issues arising from third-party systems, hosting providers or external tools.
13. Final provisions
The law of the Federal Republic of Germany shall apply. If any provision of these Terms and Conditions is invalid, the remaining provisions shall remain unaffected.
